Daphne is a Partner of the firm. Her main area of focus is in civil, corporate, and commercial disputes and her approach is to ensure her clients are well-informed and prepared for the risks and costs involved in litigation and arbitration. As part of this she explores mediation with all of her clients, allowing her to leverage on her specific training as mediation counsel.

She has experience representing clients before the General and Appellate Divisions of the High Court of Singapore and in domestic and international arbitrations of single and three-member Tribunals. Apart from this, she has substantive experience in cross-border corporate and commercial matters involving clients, fellow professionals, and counterparties from China, the United States, Europe, and Indonesia. She draws from this experience to assist her clients in presenting comprehensive case theories, strategies and narratives which reflect commercial realities. She is particularly interested in cases involving technical expertise and works closely and collaboratively with her clients to obtain a complete understanding of their evidence to enable her clients’ cases to be presented accurately and persuasively.

ARBITRATION

Defending a client in an international arbitration against a claim for breach of implied terms and the Sale of Goods Act, and in counterclaiming for license fees. The arbitration was conducted under the SIAC Rules before an international three-member Tribunal and involved contested technical issues and expert evidence. The defence was successful and counterclaim allowed in significant part.

Advising a client on the termination of their employment and subsequently representing the client in a prospective claim against a former employer for statutory illegality. Amicable settlement achieved.

Defending clients in a claim brought by a liquidator and an insolvent company for, amongst other things, unlawful means conspiracy, breach of statutory duty, unjust enrichment on the factor of illegality, breach of fiduciary duty, dishonest assistance, and knowing receipt with a total quantum in dispute of over S$130 million. The defence was successful and the claim against the clients were dismissed entirely

Acting for a client in a claim for breach of express and implied warranties in an engineering, procurement, and construction contract, and defending against a counterclaim by the contractor in a domestic arbitration governed by the SIAC Rules.
